Terms of Service
Effective date: October 12, 2026
1. About these terms
CapCats is provided by Think Languages LLC. I'm Stefano, and I build and run CapCats for that company, so these terms are written in my voice: "I" and "me" in them mean Think Languages LLC.
These terms are the agreement between you and Think Languages LLC for using the CapCats app and the pages on capcats.app.
By using CapCats you agree to these terms and to the Community guidelines. The Privacy Policy explains how I handle your data. The app points to these terms and the Privacy Policy on its first screen, and the first time you save a picture it asks you to agree to the Community guidelines. If you don't agree, please don't use CapCats.
2. Who can use CapCats
You can use CapCats if you are 13 or older, or the age at which you can agree to a service like this by yourself in your country, if that is higher.
CapCats is not directed at children.
You may not use CapCats if I deleted an account of yours for breaking these terms, unless I agree to it.
3. Your account
Guests. When you first open CapCats, it creates a guest account for you. A guest can do everything in the app. A guest account lives on one installation of the app: if you delete the app or lose your phone, you lose access to the account and its pictures, and I can't get them back for you.
Securing your account. You can secure your account with Sign in with Apple or Google, in Settings or when the app offers it. Your pictures, likes and collections stay with you. There is no email and password sign in.
Your alias. Every account has a unique alias. It is public. You can change it under the rules the app shows (for example, how often it can change). Don't choose an alias that pretends to be someone else, or that suggests you speak for CapCats.
Your responsibility. You are responsible for what happens in your account. Keep your phone and your Apple or Google account safe.
4. What belongs in CapCats
CapCats is for pictures of real cats. In short:
- Real cats, taken with the CapCats camera. Pictures are made with the camera inside the app. There is no import from your photo library.
- Cats, not people. Only the cat from your photo goes into CapCats. CapCats never uploads the full photo: it stays on your phone. Don't use CapCats to show or target a person.
- Kind words. Titles, meme text, cat names, collection titles, your alias and your first name must follow the Community guidelines.
The full rules are in the Community guidelines. They are part of these terms.
5. Your pictures stay yours
You own the pictures you make in CapCats and the text you add to them. These terms don't change that.
So that CapCats can work, you give me permission to use them in the ways the app needs. In plain words, you allow me to:
- store your pictures and text, make copies of them in the sizes and formats the app needs, and keep copies ready on servers and on people's phones so they load quickly,
- show them in CapCats to the people who are allowed to see them: in the feed, on your profile, in collections and on the pages that open from a link,
- show your public pictures to anyone, including people who have no account,
- put them into the share card, image and sticker that the Share button makes, for you and for other people (see section 6).
This permission is free of charge, covers every country, is not exclusive (you can use your pictures anywhere else you like), and lasts for as long as the picture is in CapCats. It ends when you delete the picture or your account, except for what section 7 lists as remaining.
The service providers that run CapCats for me, listed in the Privacy Policy, may do these things on my behalf, only to run CapCats. The permission does not let me sell your pictures or license them to anyone else.
You promise that you took the photo yourself with the CapCats camera, that you are allowed to share it, and that it doesn't break anyone else's rights or the law.
I don't sell your pictures, and I don't use them in advertising. I won't show them in app store listings, on capcats.app beyond the pages that open from a link, or on CapCats social media accounts unless you agreed to it first.
6. Other people's pictures
When a picture is public, other people in CapCats can:
- like it. Only you see how many likes your picture has. There is no list of who liked it. A person's own Liked collection shows the pictures they liked, unless they made it private.
- save it to their collections. A collection holds a reference to your picture, not a copy. It stays your picture and shows your alias as its creator. The collection's owner is shown as the person who collected it.
- share it. The Share button can make three things: a share card that shows your alias, a plain image of the picture, and a transparent sticker of the cat. It can also copy a link. Where the receiving app accepts text, the share carries a line that names your alias and a link to your picture. The plain image and the sticker do not have your alias printed on them.
By making a picture public, you allow other people to do these things.
When you use someone else's picture in these ways, it stays theirs. Don't pass it off as your own, and don't remove their credit from a share card.
What people do with files once they are outside CapCats is not something the app can control. A picture, card or sticker that has been shared or saved outside CapCats can't be called back.
7. Public, private and deleted
You choose. Pictures are public unless you make them private. You can choose for each picture, each cat and each collection, and you can set a default. Every picture you haven't set on its own follows the default, old and new pictures alike, so changing the default changes all of those pictures. The app tells you how many first. A private cat hides its pictures from other people. Your Liked collection is public unless you make it private.
Making something private. When you make a picture private, or the only public cat it belongs to, other people lose access to it everywhere in CapCats, including inside their own collections and Liked. If you make it public again, it comes back where it was.
Deleting. When you delete a picture, it is removed from CapCats for good, including from other people's collections and Liked, and its files are deleted.
One limit. The files of your pictures are kept at long web addresses that are not locked. An address is made of two random IDs that also appear in links: one for your account, which is in your profile link, and one for the picture, which is in the picture's link. So anyone who has a link to a picture and can find its creator's profile can work out the address of its files, and so can anyone who copied a file's address while they were allowed to see it. Such an address keeps loading after the picture becomes private, after its cats become private, after a block, while it is hidden for review and after it is removed for breaking the rules, until the file is deleted. When you edit a picture, the preview image made before your edit is deleted once the edit is saved. Deleting the picture or your account deletes the files. If deleting the files fails, CapCats keeps a note of what is left and tries again every few minutes until the files are gone.
Copies kept for speed. To deliver pictures quickly, Cloudflare's network can keep copies of picture files. When you delete a picture or your account, the files themselves are deleted straight away, but a copy kept for speed can go on loading for a while: a copy in Cloudflare's network for up to a year, and a copy on a phone or in a browser that already loaded the picture for as long as that phone or browser keeps it. I do not clear Cloudflare's copies when a file is deleted.
Your profile photo is a separate copy. It is copied from a picture of one of your public cats when you choose it. Deleting that picture, or making the picture or the cat private, does not remove the copy. To remove it, change or remove your profile photo in Edit profile.
What can remain after deletion: copies that people shared or saved outside CapCats, the copies kept for speed described above, photos in your own phone's gallery, a record of each save (the day you took the picture, your phone's time zone offset and when you saved it, without the picture) until you delete your account, usage data held by Google until Google deletes it, and database backups and technical records such as crash reports, session records and server logs, as the Privacy Policy explains.
8. Reports, blocks and moderation
Reporting. You can report a picture, a profile or a collection that breaks the rules. The person you report is not told it was you. A picture you report also leaves your feed.
Blocking. You can block someone from their profile. The two of you then stop seeing each other's pictures, cats, profiles and collections in CapCats. They are not told. You can unblock them in Settings. A block works inside the app. Public pictures and profiles can also be opened on capcats.app by anyone who has their link, and a block can't stop that.
Automatic checks. I may have the text you write in titles, meme text, cat names, collection titles, your alias and your first name checked by an automated moderation service, while you type and when you save. This can apply to private pictures and collections too. Text that the check flags can't be saved until you change it.
Under review. When three different accounts, each at least a day old, report the same picture, profile or collection, it is hidden from other people in CapCats automatically until I review it. You still see it, marked Under review. For a profile, this hides the profile photo and first name. A cat counts as a collection here, and when a cat is hidden, its pictures are hidden too, unless they also belong to another public cat.
Removal. I look at every report myself. I'm one person, so it can take a little while. If a picture, a collection, a cat (its name included), your first name or your profile photo breaks these terms or the Community guidelines, I can remove it. When a cat is removed, its pictures are hidden from other people too, unless they also belong to another public cat. You'll see a notice on your profile with the reason.
If you think I got it wrong. Write to [email protected], or use Contact support in the app, and I'll take another look. This doesn't take away any other way the law gives you to complain about a decision.
Repeated or serious breaking of the rules. I can delete an account that keeps breaking these terms, or that breaks them seriously, for example by harassing people or by sharing something illegal. Its profile, pictures, cats, collections and likes are deleted, as when you delete your account yourself. Soon after, the app on that phone is signed out of the deleted account and starts again with a new guest account. If the account was secured with Apple or Google, I may write to the email address they shared to say why.
Illegal material. I may report illegal material, and the account that shared it, to the authorities, and I will where the law requires it.
9. Things you must not do
Please don't:
- break the Community guidelines,
- use CapCats to harass, threaten or bully anyone,
- upload anything you are not allowed to share, or that breaks someone's rights,
- pretend to be someone else,
- try to get at pictures, accounts or data you are not allowed to see,
- collect pictures or data from CapCats in bulk, for example with scripts or scrapers,
- create accounts in bulk, or use reports to get someone's pictures hidden unfairly,
- interfere with CapCats, overload it, or look for ways around its limits,
- copy, change or take apart the app, except where the law or an open license that applies to that part allows it,
- use CapCats to break the law.
10. The app itself
The CapCats app, its name, its logo and its design belong to me or to those who license them to me. I give you permission to install and use the app on your own phones for your own, personal use, for as long as you follow these terms. You can't sell it, rent it or pass it off as yours.
The app includes software made by other people and shared under open licenses. Its fonts (Rubik, Source Serif 4 and Anton) are shared under the SIL Open Font License and its icons (Phosphor) under the MIT License. Those licenses give you rights of their own over those parts.
App stores. If you got CapCats from Google Play or Apple's App Store, that store's own terms also apply to your download. The store is not a party to these terms.
Apple's App Store. There is no iPhone app yet. If you get CapCats from Apple's App Store once there is one, these points also apply:
- These terms are between you and me, not Apple. I, not Apple, am responsible for CapCats and for what is in it.
- You may use CapCats only on Apple devices that you own or control, as the App Store's Usage Rules allow.
- Apple has no duty to provide maintenance or support for CapCats.
- If CapCats doesn't work as promised, you can tell Apple, and Apple will refund the price you paid for it, if any. As far as the law allows, Apple has no other duty about such promises.
- I, not Apple, handle any claim about CapCats, for example that it breaks a law, fails a legal requirement or infringes someone's rights.
- You confirm that you are not in a country under a United States embargo and not on a United States government list of prohibited or restricted parties.
- When you use CapCats, you must also follow the terms of other services you use with it, such as your mobile data plan.
- Apple and its subsidiaries may enforce these terms against you.
11. CapCats is free
In this version, CapCats is free to use. There is nothing to buy in the app, there are no ads, and there is no limit on how many pictures you can take. Nobody can pay to have their pictures shown more.
If that ever changes, I'll update these terms first.
Your phone company may charge you for mobile data.
12. Services from other companies
CapCats relies on services from other companies, such as Apple and Google for sign in and the app stores for downloads and ratings. Their own terms apply to your use of their services. The Privacy Policy lists the providers that handle data for CapCats.
13. Ending things
You can leave at any time. In the app, go to Settings, Account, Delete account. Deletion is immediate and can't be undone. Your profile, pictures, cats, collections, likes and the rest of your account are deleted, as the Privacy Policy describes. If you no longer have the app, the Privacy Policy explains how to ask me to delete your account.
Deleting the app is not enough. Deleting the app does not delete your account. For a guest, deleting the app means the account can no longer be reached, and its public pictures stay visible to other people. I don't remove guest accounts that nobody can reach any more: they stay, with their public pictures, and there is no time limit on them in this version of CapCats. So delete the account first if you want them gone.
I can end it too. I can delete an account as described in section 8. I can also stop offering CapCats, or part of it. If I decide to close CapCats, I'll announce it on capcats.app ahead of time where I reasonably can, so you have time to keep what you care about.
Sections that by their nature should outlast the end of this agreement still apply afterwards, such as section 5 for the copies that section 7 lists as remaining, and sections 6, 14, 15 and 17.
14. What I can and can't promise
I work hard to make CapCats good, but I'm one person, CapCats is free, and I offer it as it is and as available. I can't promise that it will always be available, that it will be free of faults, or that nothing will ever be lost. Keep your own copies of pictures you care about: the original photo that CapCats saves to your phone's gallery, when that setting is on, is your own file.
The pictures and text in CapCats come from the people who use it. Some pictures may come from accounts I run myself, with real cats photographed with the CapCats camera like everyone else's, and those accounts may also like and save pictures. I check reports and remove what breaks the rules, but I don't review everything before it appears, and I'm not responsible for what other people share.
Limits on my responsibility. As far as the law allows:
- I make no promises about CapCats beyond the ones written in these terms, including that it suits a particular purpose.
- I'm not responsible for indirect losses, or for losses that could not reasonably be foreseen, such as lost profits, lost opportunities or lost data.
- My total responsibility to you for everything to do with CapCats is limited to 100 US dollars.
What these limits don't touch. Nothing in these terms limits or excludes a responsibility that the law does not allow to be limited, such as for death or personal injury caused by negligence, for fraud, or for harm caused on purpose or through gross negligence. Nothing in these terms takes away the rights you have as a consumer under the law of the country where you live.
15. The law that applies
These terms are governed by the laws of the State of Wyoming and the federal laws of the United States, without applying rules that would point to the law of another place. A dispute about these terms or CapCats is heard by the state or federal courts in Wyoming.
If you use CapCats as a consumer, you also keep the protection of the mandatory rules of the law of the country where you live, and you can bring a claim in the courts there if that law allows it. Nothing in this section takes that away.
If you have a complaint, please write to me first at [email protected]. I'd like to sort it out directly.
If a part of these terms turns out not to be valid, the rest still applies. If I don't enforce a part of these terms straight away, I can still enforce it later. These terms and the Community guidelines are the whole agreement between you and me about CapCats.
16. Changes to these terms
I may update these terms, for example when CapCats gains a feature or the law changes. I'll publish the new version on this page and change the date at the top. When a change matters, for example because it changes what you allow me to do with your pictures or what you may do in CapCats, I'll also announce it on capcats.app before it takes effect. If you keep using CapCats after the new version takes effect, you accept it. If you don't agree, you can stop using CapCats and delete your account.
